Death penalty opinion filing Monday

On Monday morning, the Supreme Court will file its opinion in People v. Bertsch and Hronis.  (Briefs here; oral argument video here.)

The case is an automatic direct appeal from a December 2000 judgment of death.  Counsel for one of the defendants made an unusual request for a closed courtroom during the oral argument, but the court denied it.  (See here.)  Second District, Division Eight, Justice Victor Viramontes is sitting on the case as a pro tem because of the vacancy created by Justice Jenkins’s October retirement.  (See:  Why does the Supreme Court use pro tems?)

This will be the last of two opinions for the cases argued on the January calendar.
