On Monday morning, the Supreme Court will file its opinion in In re S.R. (Briefs here; oral argument video here.)
The court’s staff summarized the issues in S.R. this way: “(1) When a juvenile court’s jurisdictional findings establish that a parent committed an offense that the law requires be reported to the statewide Child Abuse Centralized Index (CACI), should an appellate court presume, on an otherwise silent record, the offense has been or will be reported to CACI? (2) If unrebutted, is this presumption sufficient to avoid dismissal for mootness?” The court granted review in September 2024. More about the case here.
This will be the first of two opinions in cases argued on the September calendar. The second opinion should file on Thursday.
There are a number of other argued but undecided cases in the pipeline: the four on the October calendar (three of the opinions due by January 5); the three on the November calendar (opinions due by February 2); and four death penalty appeals with opinions substantially delayed by post-argument briefing (see here and here) — the opinions in People v. Bankston, argued in early May, People v. Chhuon and Pan, argued in late May, and People v. Barrera, argued in June, might not file until February 26, and the People v. Demolle opinion, argued in October, might not file until April 23.
