Last week, the Supreme Court filed its opinion in the last argued case that had yet to be decided. There will be no argued, undecided cases until the court hears three arguments later this afternoon on its September calendar. Because of this, the court is unlikely to file any opinions for a couple of months.
The opinion drought is typical for this time of year. It’s a function of the court hearing no arguments in July and August, the requirement that the court decide its pre-July calendar cases within 90 days, and the fact that, if it follows its normal practice, the court won’t file an opinion in a September case until more than two months after it hears argument.
