“California Supreme Court won’t transfer cases from 3rd District, despite delays”

March 18, 2021

Malcolm Maclachlan reports in the Daily Journal about yesterday’s Supreme Court order denying the request of appellate attorney Jon Eisenberg and former Court of Appeal Presiding Justice Gary Strankman to transfer dozens of long-pending cases from the Third District Court of Appeal to other districts.

My guess is that the Supreme Court won’t exercise its transfer power (see Cal. Const., art. VI, sec. 12(a); rule 10.1000(a)(1)(C)) on Third District cases unless the Third District itself asks for help with its backlog.
