Yet another Prop. 47 opinion filing Monday

On Monday morning, the Supreme Court will file its opinion in People v. Jimenez, the last undecided December calendar case.  (Briefs here; oral argument video here.)

Jimenez raises the issue whether a felony conviction for the unauthorized use of personal identifying information of another (Pen. Code, § 530.5, subd. (a)) may be reclassified as a misdemeanor under Proposition 47 on the ground that the offense amounted to Penal Code section 459.5 shoplifting.  The court granted review in July 2018.

Jiminez will become the latest in a long line of Proposition 47 decisions.  And the court isn’t finished.  Two other Proposition 47 cases were argued in January and one more in February.
