The University of California today filed in the Supreme Court a petition for review and a request for a stay of a superior court order requiring the disclosure tomorrow of what the UC says is a confidential settlement proposal it received from the U.S. Department of Justice. (Regents of the University of California v. Superior Court.) The First District, Division Three, Court of Appeal yesterday summarily denied a writ petition that sought to prevent disclosure.
According to the petition and Jaweed Kaleem’s Los Angeles Times report, the Times has obtained a copy of the proposal and published a summary of it, but hasn’t released the proposal itself.
It’s possible that the mere seeking of appellate relief from the superior court’s order is enough to stay disclosure until the Supreme Court rules. (See Fairfield v. Superior Court (1966) 246 Cal.App.2d 113, 122; cf. People v. Superior Court (Mitchell) (2024) 17 Cal.5th 228, 251 (see here).)
