Supreme Court rules on off-site environmental mitigation

In a unanimous opinion written by Justice Kathryn Werdegar, the Supreme Court in City of San Diego v. Board of Trustees of the California State University today holds that Cal. State University could not avoid paying to mitigate off-campus effects of a San Diego State University expansion plan solely based on the Legislature’s express failure to make a specific appropriation for the mitigation.  [Disclosure:  Horvitz & Levy represents Cal.
