Supreme Court rejects challenge to continuation of Governor’s emergency declaration

August 18, 2021

The Supreme Court today summarily denied an original writ petition, filed last week, that sought termination of Governor Gavin Newsom’s March 2020 proclamation of a state of emergency in response to the Covid-19 pandemic.

The denial, in Orange County Board of Education v. Newsom, is consistent with the court’s hands-off posture toward pandemic orders by state and local governments.  (See:  Pandemic docket update.)
