At the beginning of the month, the Supreme Court temporarily blocked a San Diego court trial in a business tort case that defendant said in a petition for review would be “a potential ‘super-spreader’ event” because of the COVID-19 pandemic. On Wednesday, however, the court found unpersuasive a similar claim about a personal injury jury trial scheduled to start soon in Riverside.
In Board of Trustees of the California State University v. Superior Court, yet one more case on the court’s pandemic docket, the court denied a petition for review and stay request after the Fourth District, Division Two, Court of Appeal had summarily denied a writ petition.
So, while the safety of the in-person San Diego trial will be analyzed by the Court of Appeal at the Supreme Court’s behest, jury selection in the Riverside case is expected to resume on Monday according to a news report (see here).
