Supreme Court calls for answer in sheriff ballot seizure case

The Supreme Court this morning requested an answer to California Attorney General Rob Bonta’s petition for review in Attorney General v. Bianco.  The petition alleges a county sheriff has disregarded Bonta’s directives to pause the sheriff’s investigation into the November 2025 election and to preserve the county ballots and other materials the sheriff seized last month.

The court has set an expedited briefing schedule.  The answer is due before 10:00 a.m. on Wednesday and Bonta has two days after that, also by 10:00 a.m., to reply.

In an original writ petition seeking similar relief (Cervantes v. Bianco), the petitioners today filed a reply to the sheriff’s preliminary opposition.

Meanwhile, Laurie Perez and Dean Fioresi report for CBS News that the sheriff yesterday indefinitely stopped his investigation “due to legal challenges from the California attorney general.”  The report quotes a sheriff’s statement saying, “We are on hold because of the politically motivated lawsuits and court filings.”

According to Garrett Hottle’s piece for News Channel 3, a superior court judge is hearing arguments today in a related lawsuit Bonta filed that is separate from the case in which he is seeking Supreme Court review.
