Still no ruling on the anti-death-penalty writ petition

For the second time, the Supreme Court didn’t announce a ruling on Office of the State Public Defender v. Bonta — the original writ petition attacking California’s death penalty system as racially discriminatory — after it was on the list of matters scheduled to be considered at the next day’s conference. (See here and here.)

The court this afternoon released its list of today’s conference actions and the writ petition isn’t on it. Nor is there currently any entry on the case’s docket after May 16.

We’ve suggested there might be a separate statement in the works. This second delay might mean that a response to a separate statement is now in the drafting stage.
