Punitive damages issue headed for Supreme Court review?

Our firm’s California Punitive Damages blog reports on an unpublished Court of Appeal opinion that includes a potentially review-worthy issue — whether the heightened “clear and convincing evidence” standard of proof for imposing punitive damages at trial affects an appellate court’s review of a punitive damages award.  The blog notes the Supreme Court granted review seven years ago of another unpublished opinion raising the issue, but review was later dismissed when that case settled.
