Prosecutor misconduct opinion filing tomorrow

December 3, 2014

Tomorrow morning, the Supreme Court will file its opinion in People v. Centeno, which was argued on the October calendar.  The court will answer this question:  did the prosecutor commit misconduct during closing argument by misstating the state’s burden of proof?  After scheduling the case for argument, the court asked the parties to be prepared to address whether defense counsel was constitutionally ineffective for failing to object to the prosecutor’s argument.

The opinion can be viewed tomorrow starting at 10:00 a.m.
