Juvenile offenses opinion filing tomorrow

Tomorrow morning, the Supreme Court will file its opinion in In re F.M. (Briefs here; oral argument video here.)

This will be the third opinion in the four cases argued in February. A decision in the final case — the death penalty appeal in People v. Wilson — isn’t due until June 15 because of post-argument supplemental briefing. Opinions in the five March calendar cases should file by June 5.

F.M. is expected to decide whether the Court of Appeal erred in ruling that the trial court adequately exercised its discretion to determine whether the juvenile’s offenses were felonies or misdemeanors as required by Welfare and Institutions Code section 702 and In re Manzy W. (1997) 14 Cal.4th 1199. In October 2021, the court granted the petition for review that was filed 10 days late.
