In a California Law Review essay, Justice Goodwin Liu says that, since the U.S. Supreme Court’s Bakke decision, “we have conflated concepts of justice with concepts of diversity” and that “[d]iversity rationales greatly expand the number of groups entitled to claim preference or special protection, and they are an awkward fit as justifications for policies designed to address entrenched patterns of racial subordination.”
