“In California, praise for Jackson but lamentations for Kruger”

Craig Anderson reports in the Daily Journal that “several state attorneys, on the left and right, expressed disappointment that California Supreme Court Justice Leondra R. Kruger — a reported finalist for the [U.S. Supreme Court] vacancy — was not chosen.”

Horvitz & Levy partner Jeremy Rosen is quoted: Nominee Ketanji Brown Jackson “seems well qualified to sit on the court. But I continue to believe that Justice Kruger would have been a more exceptional choice.”

The article also includes this: “A few people speculated that Kruger might be selected for a D.C. Circuit [Court of Appeals] vacancy if she [were] not chosen for the Supreme Court, but others are skeptical she would take the position if offered.” Josh Blackman at The Volokh Conspiracy is one of the speculators. He says Justice Kruger’s serving on the D.C. Circuit would “[p]resumably . . . put her in a much stronger position to fill the next Supreme Court vacancy.”
