Death penalty opinion filing tomorrow

The Supreme Court tomorrow morning will file its opinion in People v. Duff, an automatic appeal from a March 2002 judgment of death.  Court of Appeal Presiding Justice Judith McConnell is sitting on the appeal in place of Chief Justice Tani Cantil-Sakauye.  Duff is the last case from the November oral argument calendar without an opinion yet, possibly because the case was not submitted until defendant filed a letter brief 10 days after argument.

The opinion can be viewed online tomorrow beginning at 10:00 a.m.
