For the second year in a row, the Daily Journal legal newspaper has honored Horvitz & Levy LLP partner Felix Shafir as one of California’s Top Labor & Employment Attorneys. The Daily Journal praised Felix for his work on behalf of employers seeking to enforce arbitration agreements in employment contracts and related waivers of class action proceedings. The Daily Journal took particular note of Felix’s amicus briefing in Iskanian v. CLS Transportation of Los Angeles, S204032, in which the California Supreme Court recently held that under the U.S. Supreme Court’s decision in AT&T Mobility LLC v. Concepcion (2011) 563 U. S. __, 131 S.Ct. 1740, the Federal Arbitration Act preempts the California Supreme Court’s previously articulated rule against employment class waivers. In Iskanian, the California Supreme Court also held federal labor law does not foreclose enforcement of a class action waiver in an employment arbitration agreement.
