Tomorrow morning, the Supreme Court will file its opinion in Conservatorship of E.A. (Briefs here; oral argument video here.)
As summarized by court staff, the issue is, “Must a conservatee demonstrate prejudice to establish that a 362-day delay in initiating a trial in a Lanterman-Petris-Short Act conservatorship proceeding violates due process and equal protection?” The court granted review in December 2024. More about the case here. Fourth District, Division Three, Justice Thomas A. Delaney is the pro tem.
This will be the fourth of nine early-May cases to be decided. The other five should be decided by August 3. However, for those five, there are only three regular filing days left within the 90-day filing period.
