Cert denied of divided Supreme Court opinion on jury trial waivers

The U.S. Supreme Court today denied the certiorari petition in People v. Sivongxxay.  A 5-2 California Supreme Court had affirmed the defendant’s death sentence, with the dissenters claiming that the defendant had not adequately waived his right to a jury trial on the special circumstances issue that made the defendant eligible for capital punishment.

The validity of jury trial waivers has divided the state high court in several cases recently.
