Assembly resolution would encourage retroactive application of new lower bar pass score

August 20, 2020

Ten days ago, the Supreme Court announced it will not retroactively apply the lower bar passing score that it ordered last month.  That hasn’t stopped five members of the California Assembly from this week introducing a resolution that would “strongly encourage[ ]” the justices to change their minds.

Among other things, the proposed resolution states that the bar exam “has historically had a racially discriminatory impact on people of color and, therefore, on the legal profession as a whole.”

The legislators want the new score applied retroactively to July 2015.
