Arches v. Lee (2026)

Horvitz & Levy persuaded the Court of Appeal to affirm a defense judgment, finding there was no merit to plaintiff’s evidentiary error arguments.

Plaintiff filed this personal injury action alleging that defendant was negligent in making a right turn in her car, colliding with plaintiff on his bicycle.  Following a defense verdict, the trial court entered judgment in favor of defendant and later awarded her $99,800 in expert witness fees.  Plaintiff appealed, contending the trial court committed multiple evidentiary errors, including (1) allowing defendant’s accident reconstruction expert to testify without having served a pretrial report; (2) declining to conduct an Evidence Code section 402 hearing before allowing defendant’s retained accident reconstruction expert to present animations; and (3) excluding from evidence the written report of plaintiff’s accident reconstruction expert.  Plaintiff also appealed from the trial court’s post judgment order awarding expert witness fees and other costs.

Horvitz & Levy was retained to handle the appeal and convinced the Court of Appeal to affirm the favorable judgment. The court rejected all of plaintiff’s arguments, finding that the trial court did not abuse its discretion in any of its evidentiary rulings or its award of costs.
