Another Prop. 47 vehicle crime opinion filing tomorrow

Tomorrow morning, the Supreme Court will file its opinion in People v. Orozco, which was argued in January.  (Briefs here; oral argument video here.)

The issue in Orozco is whether a felony conviction for receiving a stolen vehicle in violation of Penal Code section 496d can be reclassified as a misdemeanor under Proposition 47 in light of Penal Code section 496, subdivision (a), which provides that receiving other stolen property is a misdemeanor when the value of the property does not exceed $950.  The court granted review (for a second time) in August 2018.

Orozco will be the second Proposition-47-vehicle-crime opinion this week.  On Monday, the court held in People v. Bullard that Proposition 47 can reduce the sentence for a conviction of temporarily taking a vehicle worth less than $950.
