Court of Appeal bail opinion remains non-binding as new legislation heads to the Governor

The Supreme Court today denied a request to have the Court of Appeal opinion in In re Humphrey remain binding precedent pending review.  That comes a day after the Legislature passed a bill that, if signed by the Governor, will dramatically change California’s pre-trial detention system.

If the bill becomes law, look for the court to ask for supplemental briefing regarding whether the new legislation moots the Humphrey case.
