Tomorrow morning, the Supreme Court will file its opinion in People v. Perez, the last undecided case from the November calendar. (Briefs here; oral argument video here.) The opinion is being filed more than 90 days after the argument because of post-argument supplemental briefing.
Perez is an automatic direct appeal from a January 2002 judgment of death. Although the court’s website does not list issues for those appeals, the court last August requested supplemental briefing about “the effect of recent precedent on the hearsay and confrontation clause issues” related to a particular witness’s testimony. The court’s briefing order cited the People v. Sanchez (2016) 63 Cal. 4th 665 case (see here and here) and eight decisions from other states.
