The long and the short of it

December 8, 2010

This week gives us more reminders about the great disparity in the amount of time it can take the Supreme Court to decide a case.

Yesterday, the court heard oral argument in California Farm Bureau Federation v. State Water Resources Control Board, S150518, more than three and a half years after granting review. And, according to the Daily Journal (subscription required), after all this time, the court might end up just remanding the case because of an insufficient record.

On the other hand, the court has already heard argument and tomorrow will file its opinion in Dana Point Safe Harbor Collective v. Superior Court, S180365, only nine months after granting review, and that’s not a record.
