We prepared a petition in the Ninth Circuit requesting permission to pursue an interlocutory appeal of a class certification order in an action alleging “fax blasting” in violation of the federal Telephone Consumers Protection Act (TCPA). After the petition was filed, the plaintiffs substantially reduced their settlement demand and the case settled on terms favorable to the defendant.
