The list of matters scheduled for tomorrow’s Supreme Court’s conference includes the petition for review in Civil Rights Department v. Cathy’s Creations, Inc.
In the case, the Fifth District Court of Appeal, in a published opinion, validated California’s lawsuit against a bakery for violating the State’s Unruh Civil Rights Act. The alleged violation was a bakery’s refusal to sell a predesigned cake because it was intended for use at the customers’ same-sex wedding reception. Among other things, the bakery and its owner relied on their First Amendment free-speech and free-exercise-of-religion rights, which the Fifth District held to be inapplicable.
