Tomorrow morning, the Supreme Court will file its opinion in Estrada v. Royalty Carpet Mills, Inc. (Briefs here; oral argument video here.)
This will be the first of the four cases argued in November to be decided. Opinions in two of the others should file by February 5. Because of post-argument briefing, an opinion in the fourth case — the death penalty appeal in People v. Helzer — isn’t due until February 15. (See here.)
When the court granted review in June 2022 in Estrada, it limited the issue to: “Do trial courts have inherent authority to ensure that claims under the Private Attorneys General Act (Lab. Code, § 2698 et seq.) will be manageable at trial, and to strike or narrow such claims if they cannot be managed?” More about the case here.
The Estrada opinion can be viewed tomorrow starting at 10:00 a.m.
We usually summarize court opinions on the day they’re filed. Estrada will likely be an exception. Tomorrow, I’ll be attending Chief Justice Patricia Guerrero’s meeting with the media and I’ll then be traveling back from San Francisco. So, there probably won’t be an Estrada write-up until Friday.
