The Los Angeles Times’ Maura Dolan reports: “Opponents of same-sex marriage asked the California Supreme Court on Friday to order county clerks to deny marriage licenses to same-sex couples, arguing that Gov. Jerry Brown lacked the authority to end enforcement of Proposition 8.”
The opponents today filed a writ petition and requested a stay. A ruling could come at any time. “Legal experts predicted the California court would reject the challenge,” the Times article says.
UPDATE: The court has asked the Governor and other real parties in interest to file by 8:00 p.m. tonight an informal opposition to the stay request. The same-sex-marriage opponents will have until 9:00 a.m. Monday to reply. The court also has asked for a preliminary opposition “concerning the remainder of the petition” to be filed by July 22 and has given the opponents until August 1 to reply to that preliminary opposition.
