Correction: Sonic-Calabasas’s time on the Supreme Court docket isn’t as long as we made it sound

In discussing the Supreme Court’s April calendar, we said that one matter to be argued “is among the oldest pending civil cases on the court’s docket — review was granted three and a half years ago in Sonic-Calabasas A, Inc. v. Moreno.” That statement was misleading.

Review was granted in Sonic-Calabasas three and a half years ago. However, what we overlooked was that the Supreme Court issued an opinion in that case in February 2011 and that the United States Supreme Court subsequently remanded the case “for further consideration in light of AT&T Mobility LLC v. Concepcion, 563 U.S.__ (2011).” The remand occurred only about 15 months ago. So, the case started on the California Supreme Court’s docket quite a while ago, but the matter took a detour to Washington for a substantial amount of time.
