Adding yet another case to the Supreme Court’s pandemic docket, the Orange County Board of Education and others yesterday filed this original writ petition asking the court to terminate Governor Gavin Newsom’s March 2020 proclamation of a state of emergency in response to the Covid-19 pandemic.
The petition in Orange County Board of Education v. Newsom claims that “Californians are living in a seemingly perpetual quasi-state of emergency” and argues it is wrong that “policy decisions continue to be made not by elected officials but, by and large, by unelected public health officials in Sacramento or Washington, D.C., who operate behind closed doors with little transparency about how they make decisions and no opportunity for public debate.”
