Supreme Court asked to reassign Court of Appeal cases

Following a complaint by appellate attorney Jon Eisenberg to the Commission on Judicial Performance about substantial delays by the Third District Court of Appeal — and three of its justices in particular — in deciding appeals, Eisenberg and retired First District Presiding Justice Gary Strankman have asked the Supreme Court to transfer 57 long-pending appeals from the Third District to other California appellate courts.  (See here, here, here, and here.)

Rule 10.1000(a)(1)(C) gives the Supreme Court the power to “transfer a cause . . . [b]etween Courts of Appeal.”
