Two death penalty opinions — first opinions since August — are filing Monday

On Monday morning, the Supreme Court will file its opinions in People v. Schultz and People v. Flinner.  (Briefs here; oral argument videos here and here.)  Both cases were argued in September.  All four cases on that month’s calendar have a Court of Appeal justice sitting pro tem.

These will be the first Supreme Court opinions since the end of August.  The gap between filings is expected this time of year.

The other two September cases should file one week from Monday, the last regular filing day within the 90-day period.

Schultz is an automatic direct appeal from a March 2003 judgment of death. The court’s website does not list issues for such cases. Counsel was appointed in August 2008. Briefing was completed in July 2014.  Fourth District, Division Three, Justice Thomas Goethals is the pro tem.

Flinner is an automatic direct appeal from a March 2004 judgment of death.  Counsel was appointed in June 2009. Briefing was completed in July 2014.  Sixth District Presiding Justice Mary Greenwood is the pro tem.
