The Supreme Court today affirms the death sentence in People v. Duong for fatally shooting four people at an El Monte nightclub in 1999.
Among many other things, the court’s unanimous opinion by Justice Carol Corrigan rejects defendant’s claim he shouldn’t have been tried in Los Angeles County because of pretrial publicity and concludes any error in admitting evidence from a warrantless vehicle inventory search was harmless.
As it has before, the court also summarily dismisses an argument that juries should be required to make unanimous findings on aggravating factors, an issue about which it has asked for supplemental briefing in another capital appeal. (See here and here.)
