Inverse condemnation opinion filing tomorrow

Tomorrow morning, the Supreme Court will file its opinion in Weiss v. People ex rel. Department of Transportation.  (Briefs here; oral argument video here.)  The case was argued on the early-May calendar.

Unlike with a special filing this coming Friday, the court gave the usual one day’s notice of the forthcoming filing.

In Weiss, the court will decide if the procedure permitted by Code of Civil Procedure section 1260.040 can be used in an inverse condemnation action to determine in advance of a bench trial whether a taking or damaging of private property has occurred.  The court granted review in June 2018.

The opinion can be viewed tomorrow starting at 10:00 a.m.
