The Supreme Court announced this afternoon that it will file an opinion Friday morning in Legislature of the State of California v. Padilla.
The case concerns the Legislature’s request for a four-month delay of the deadline for the state Citizens Redistricting Commission to submit Congressional, state legislative, and Board of Equalization district maps for the 2022 election.
This is an unusual case. The court will be issuing an opinion to decide a writ petition filed directly in the Supreme Court (rare, but not unheard of), nobody has opposed the petition (rarer still), and the opinion will file without oral argument (rarest of all). (See here.)
The opinion’s filing itself is unusual, too. First, the court usually gives only one day’s notice of a forthcoming filing. Second, the court almost always files its opinions only on Mondays and Thursdays. (See here.)
