The U.S. Supreme Court today denied certiorari in OTO, L.L.C. v. Kho (2019) 8 Cal.5th 111. There, a 6-1 California Supreme Court last August found “oppressive circumstances” surrounding the formation of an agreement to arbitrate a wage dispute, which made the agreement unconscionable and therefore unenforceable.
