Handing a victory to a class of California state judges, the Supreme Court this morning denied the petition for review in Mallano v. Chiang. [Update: here’s the order.] This is the case where the six current justices recused themselves — apparently because they were financially interested in the matter, which involved judicial pay — and were replaced by six superior court judges who all took the bench less than a year ago. None of those judges voted to grant review.
