Developments in California Law 

This one-hour seminar examines a number of recent developments in key areas of California law, including punitive damages, intellectual property, the anti-SLAPP statute, wage & hour litigation, insurance, healthcare and the Unfair Competition Law/Proposition 64. 

Anti-Slapp Litigation 

Jeremy Rosen has been lead counsel in a wide variety of appeals dealing with California’s anti-SLAPP statute. Jeremy’s seminar presentation will outline recent trends and unresolved questions in anti-SLAPP litigation, summarize anti-SLAPP issues pending in the California Supreme Court, and review tips to help trial counsel identify when to file an anti-SLAPP motion. 

Class Actions/Unfair Competition Law 

John Taylor has been lead counsel in several appeals involving Unfair Competition Law (UCL) and Proposition 64 issues, including the reversal of a state-wide injunction against DaimlerChrysler.

Brad Pauley has handled a number of class action-related appellate matters involving the UCL, the Automobile Sales Finance Act (ASFA) and the federal Telephone Consumer Protection Act.

Their seminar presentation surveys the fundamentals of class action law, the special problems of wage and hour class actions and class actions brought under the Consumer Legal Remedies Act, issues arising from the Class Action Fairness Act, and the use of UCL and Proposition 64 in class actions. 

Healthcare 

H. Thomas Watson has litigated numerous healthcare issues on appeal. He most recently argued before the California Supreme Court in Mileikowsky v. West Hills HMC, a case involving the conduct of hospital peer review proceedings. Tom’s seminar presentation reviews recent decisions concerning the application of MICRA, balance billing, hospital peer review and liability for intentional torts in the healthcare setting. 

Insurance Coverage And Bad Faith 

Mitch Tilner, a member of the State Bar Insurance Law Committee, has been involved in numerous bad faith appeals. He reviews the most recent developments in insurance bad faith and coverage law, including the genuine dispute doctrine, coverage for intentional acts, relationships between primary and excess carriers, and scope and determination of Brandt fees. 

Punitive Damages 

Curt Cutting, founder and lead contributor to the calpunitives.com legal blog, has handled numerous cases in which multi-million dollar punitive damages awards were reversed or sharply reduced. Curt’s seminar presentation surveys the recent trends and pending issues in punitive damages litigation in California and nationwide. 

The Appellate Process 

David Axelrad has specialized in civil appeals for over 26 years and is a member of both the California Academy of Appellate Lawyers and American Academy of Appellate Lawyers.

Peder Batalden has been lead counsel in a variety of appeals that give him special expertise in federal appellate procedure. David and Peder provide an overview of state and federal appellate procedure and techniques for preserving the record in the trial court in order to maximize the chances for success on appeal. 

Toxic Torts 

David Axelrad has participated in a wide variety of toxic tort cases on appeal, including the Lockheed Litigation Cases and Johnson v. American Standard. David offers a seminar presentation examines a number of cutting-edge issues in California toxic tort litigation including the “sophisticated user” and “sophisticated purchaser” defenses, developing trends in duty to warn claims, challenges to expert testimony, and the requirements for proof of causation.
