July 7, 2011
On Tuesday, July 12, 2011, Horvitz & Levy partner David Axelrad will argue unresolved standing and political question issues raised by public nuisance litigation seeking redress for the alleged consequences of global warming. In a mock U.S. Supreme Court oral argument to be presented at the annual meeting of the International Association of Defense Counsel in Whistler, British Columbia, Mr. Axelrad, who will advocate the plaintiffs’ position, will oppose Richard Faulk, Chair of the Litigation Department and an experienced appellate advocate at Gardere Wynne Sewell LLP in Houston, Texas. The panel of judges includes former Chief Justice of the Texas Supreme Court Thomas R. Phillips, former U.S. Court of Appeals for the D.C. Circuit Judge and current president of Baylor University Kenneth Starr, and Justice Evelyn J. Lundberg Stratton of the Supreme Court of Ohio. Houston attorney Joseph F. Speelman of Blank Rome LLP is the coordinator of the program and will provide an introduction and analysis of the case before the argument begins. Professor Donald Gifford of the University of Maryland School of Law will lead a discussion following the argument.
