The Daily Journal has included Boermeester v. Carry  in its Top Verdicts 2023 list. 

The publication spotlights California's largest and most significant verdicts and appellate reversals in 2023. 

USC expelled student Matthew Boermeester following an investigation that determined he violated USC's policy against intimate partner violence by physically assaulting his girlfriend. Boermeester sued in superior court, claiming USC's disciplinary proceedings violated his common law right to fair procedure. In a divided opinion, the Court of Appeal agreed with Boermeester and imposed a burdensome requirement that a university must permit  

live cross-examination of witnesses before disciplining a student for intimate partner violence. Horvitz & Levy successfully petitioned the California Supreme Court, which unanimously agreed with our arguments and, reversing the Court of Appeal, held that fair procedure does not require providing a live hearing with cross-examination.
