Beckman Coulter v. Dovatron International Inc., et al. (Orange County Sup. Ct. No. 01CC08395)

Beckman Coulter sued Flextronics International and its related entities for breach of contract, fraud, and economic duress. The jury awarded $934 million in damages, $931 million of which was punitive damages.

The Flextronics defendants retained Horvitz & Levy LLP to assist in preparing post-trial motions challenging the jury’s economic duress award and arguing the punitive damages were excessive. During the hearing on the post-trial motions, the parties agreed to a $23 million settlement. Beckman’s attorney subsequently acknowledged, "‘It was pretty obvious to us that our verdict was either going to be thrown out or chopped down to a few million bucks at best.’" The settlement was widely reported in the financial press, including the Wall Street Journal and Los Angeles Times.
