Coulter v. Dovatron International Inc., et al.

Beckman Coulter sued Flextronics
International and its related entities for breach of contract,
fraud, and economic duress. The jury awarded $934 million
in damages, $931 million of which was punitive damages.
The Flextronics defendants retained Horvitz
& Levy LLP to assist in preparing post-trial motions challenging
the jurys economic duress award and arguing the punitive
damages were excessive. During the hearing on the post-trial
motions, the parties agreed to a $23 million settlement. Beckmans
attorney subsequently acknowledged, "It was pretty
obvious to us that our verdict was either going to be thrown
out or chopped down to a few million bucks at best."
The settlement was widely reported in the financial press,
including the Wall Street Journal and Los Angeles Times.
