Unfair Competition Law (UCL)

LLP has extensive experience in representing and counseling
clients in disputes involving California’s unfair
competition law (UCL), Business & Professions Code
Section 17200 et seq. (See a representative
list of the unfair competition cases which
have been handled on appeal by Horvitz & Levy LLP.)
Our UCL practice has grown substantially
in recent years, and includes defending against litigation
brought by business
competitors as well as consumers. Specifically, our appeals
have addressed such cutting-edge issues as the standard for
determining whether a business practice is “unfair,” the
scope of legislative “safe harbor” provisions
insulating defendants from liability, equitable defenses
to UCL remedies, the interplay between class action rules
and representative UCL proceedings, and procedural limitations
on unfair competition actions.
In
addition, Horvitz & Levy
LLP is actively involved in litigation concerning the application
of Proposition 64,
a voter initiative enacted in November, 2004 that significantly
amended Section 17200. For example, our firm
has filed briefs in several cases on the issue whether Proposition
64 applies
