the Court of Appeal issued its initial opinion in this
case, the parties filed petitions for review in the California
Supreme Court. On August 2,
2006,
the
Supreme Court ruled as follows:
Plaintiff Jodie
Bullock's petition for review DENIED. Defendant Philip
Morris USA, Inc.'s petition for review GRANTED. Further
action in this matter is deferred pending the
decision of the United States Supreme Court in Philip
Morris USA v. Williams (Or. 2005) 127 P.3d 1165,
cert. granted May 30, 2006, No. 05-1256, __ U.S. __ [126
S.Ct. 2329], or further order of this court. George,
C.J., was absent and did not participate. Votes: Baxter,

Werdegar, Chin, Moreno, and Corrigan, JJ.
After the Williams case was decided,
the California Supreme Court remanded the case for further
proceedings in light of Williams. (Click
here to read briefing and articles related to the : Philip
Morris USA v. Mayola Williams case decided by
the United States Supreme Court on February 20, 2007.) The
Court of Appeal then ordered supplemental briefing, which
was followed by an order inviting
answers from the parties and assorted amici curiae to three
questions regarding implementation of the Williams decision.
All briefing is completed, and oral argument took place on
December 12, 2007. The Court of Appeal issued its opinion
on January 30, 2008. Both parties have filed petitions for
review.
